Statement of States at the 6th Negotiation Session of the Legally Binding Instrument on Transnational Corporations and Other Business Enterprises with Respect to Human Rights

Abstract
The present work aims at analyzing the position of the States participating in the 6th negotiation session of the legally binding instrument on transnational corporations and other business enterprises with respect to human rights. Through the analysis of the official documents of the session, the statements released by the countries and the report prepared internally by Homa during the negotiations, the most relevant positions on key points of discussion were selected, especially regarding to the effectiveness of the treaty, namely, primacy of the human rights, scope, direct obligations to business, legal liability and due diligence, extraterritoriality mechanisms, forum non conveniens and forum necessitatis, and mutual legal assistance. As a result of the research conducted here, it is possible to better understand the current scenario of the negotiation and to draw panoramas in the near future.
