Resumo
O artigo investiga aspectos do precedente alemão e sua relevância no fenômeno mundial caracterizado pela crescente intervenção judicial na proteção ambiental. A relevância ímpar da decisão no cenário global decorre de sua interpretação inovadora e associativa de direitos e deveres climáticos com direitos fundamentais constitucionais e direitos humanos, catalisando ações legislativas e ressignificando institutos jurídicos. A investigação revela uma contribuição concreta do precedente para uma efetiva tutela de direitos climáticos no cenário mundial, a partir de uma perspectiva cooperativa do papel dos Estados e Tribunais, de governança global, associada aos direitos humanos. A metodologia utilizada neste trabalho é qualitativa e descritiva, realizada por meio de análise bibliográfica e documental, com foco na abordagem associativa do Tribunal a direitos humanos e constitucionais e suas potenciais repercussões no cenário internacional sobre o tema, como marco no recente fenômeno dos litígios climáticos no globo.
