Abstract

The article investigates aspects of the German precedent and its relevance in the global phenomenon characterized by increasing judicial intervention in environmental protection. The unique relevance of the decision on the global stage arises from its innovative and associative interpretation of climate rights and duties with fundamental constitutional rights and human rights, catalyzing legislative actions and giving new meaning to legal institutes. The investigation reveals a concrete contribution of the precedent to the effective protection of climate rights on the global stage, from a cooperative perspective on the role of States and Courts, of global governance, associated with human rights. The methodology used in this work is qualitative and descriptive, carried out through bibliographic and documentary analysis, focusing on the Court's associative approach to human and constitutional rights and its potential repercussions on the international scene on the topic, as a milestone in the recent phenomenon of climate litigation on the globe.
