THE RIGHT TO EDUCATION AND THE EFFECTIVENESS OF COMPULSORY OF BASIC EDUCATION IN MOZAMBIQUE

This text analyzes the effectiveness of the extension of compulsory basic education in Mozambique. The reference is the ongoing education reform, viewed as a sign of the expansion of the right to education, with the promulgation of Law 18/2018 of 28th December 2018. From a methodological procedures, we punctuated the main focuses of the global and regional African agenda with regard to the right to education, starting with the examination of documents from the United Nations Organization, since 1948, including the Summit on the Education Transformation (2022) and the African regional agenda on the right to education. Then, in a second part, we examine the documents regarded to the formulation of the Right to Education in the country, analyzing the scope of global commitments, describing the process of recent education reform in Mozambique, highlighting the main innovations: the explanation of the concept of education basic the extension of its obligation to 09 classes. Based on this documentation, and on the results of some studies, the text argues that Mozambique's biggest challenge, as a country on the periphery of capitalism, dependent on external aid, is still guaranteeing the effective enjoyment of the right to education social majorities. In this challenge, the search for new financing mechanisms for investment in education is pertinent for the country to move away from cultural marginality. In addition to the actions that have been carried out by the Ministry of Education and various organizations in defense of the right to basic education, one of the education financing mechanisms would be the creation of a Basic Education Fund, whose primary source would be the various funds existing in the country and the consideration of taxation of natural resources. By doing so, the country can face the challenges arising from educational reform, guaranteeing, therefore, the human right to basic education in 9 classes: access, permanence, successful completion and effective learning
