Abstract

Digital evidence is now mostly held by providers and platforms, so criminal investigation depends on requests addressed to private entities. Upon receiving them, the company acts as guarantor of the fundamental rights of data subjects, third parties absent from the requesting relationship. This article examines the limits of the duty to cooperate and the role of privacy compliance in safeguarding those rights. It adopts the deductive method, with bibliographical, documentary and case-law research. It concludes that the duty to cooperate is limited by legality, judicial reservation, proportionality and minimization, that observing these limits requires structured privacy compliance and that the excessive disclosure of data produces the unlawfulness of the evidence, the breaking of the chain of custody and the administrative, civil and criminal liability of the company.
