This article presents a discussion about the performance of the National Education Council (CNE) during the coronavirus pandemic, specifically in 2020 and 2021. The objective is to analyze to what extent the CNE's actions converge to the current legislation with regard to the specificities of Early Childhood Education. The various contradictions present in the institution's legal opinions and recommendations may have contributed to the strengthening of pedagogical practices that deviate from current educational legislation. Thus, it problematizes questions related to ethics in the relationship with children, the organization of spaces, times and materials in the educational context and the actions of Early Childhood educators, in order to promote a critical reflection on possible untested feasibility for Early Childhood Education after the resumption of face-to-face assistance in day care centers and preschools. The intention is that the questions addressed can support discussions within the institutions, involving the entire school community, in order to evaluate the educational process in the period prior to the pandemic, as well as the actions to be taken for the collective construction of an education as a practice of freedom.
