EDUCATION, SCHOOLING AND FREEDOM IN THE SOCIO-EDUCATIONAL SYSTEM

The aim of this paper is to problematize the role of the right to education in the socio-educational system based on its ambiguities. At first, it is intended to demonstrate that such ambiguities are already present in the modern conception of education or pedagogy, tensions that will also be absorbed in terra brasilis, especially by the legislation of the 20th century. Based on the analysis of research carried out by the Working Group and Studies on Policies of Restraint and Deprivation of Liberty of the Universidade Federal Fluminense, it is intended to demonstrate the profile of adolescents in conflict with the law and how the such subjects play a fundamental role in the evaluation, by the police authority, on the need to maintain, or not, their administrative apprehension. Based on the analysis of some decisions of the São Paulo Court of Justice, the objective is to discuss the extent to which adolescents' non-adherence to a project of re-socialization through education can be taken into account as a criterion of recrudescence their legal situation. The methodology will consist of a bibliographic review on the subject and an analysis of empirical data, with incursions in the fields of law, philosophy and sociology.
