Abstract

This article seems to analyses the normative construction of precarious labor processes in Brazil that affects actual working relationships. The period analyses is established since Federal Constitution until 2015. The federal norms of precarious labor are studied from three specific carachteristicas: hiring, journey and remuneration. The analysis is theoretically based in and structural reference, the sociology of labor, the welfare state in Brazil and the conceptualization of Brazilian social policy. Methodologically, the study applies to bibliographical review and documental analysis. It is concluded that precarious labor relationships in Brazil have been institutionalized with specifics legislations and contradicts the dispositions of the Constitution and the CLT that still continue to be significant norms in the defense of stable labor relationships and recognizing labor rights.
