Abstract

In this paper, we analyze the institutional trajectory of the Oswaldo Cruz Foundation (Fiocruz) regarding its legal nature in the 1970s, when it was created, and 2003, the year in which the current statute was drafted. In this way, we seek to understand two periods of the institution: from 1970 to 1988, in which it responds by private law; and from 1988, the year of the promulgation of the Brazilian Constitution, until 2003, when it falls under the regime of public law. For the second subperiod we will examine the documentation of the entity's internal congresses, in which the possibilities of flexibility of management within the limits of public law were discussed. The aim is to understand the public and private dichotomy and the ways in which to choose a support foundation as an alternative to Fiocruz's management administration project.
