9) A prudência e a virtude retóricas na produção da credibilidade em sentenças judiciais

Abstract

Inglês: Using rhetorical and argumentation theories, as well as enunciation theories used in Greimas’ semiotics, this paper intends to analyze how the character of judges, the sentence’s enunciator, appears in juridical sentences. It shows how prudence and virtue constitute the ethos of judges and produce credibility in the discourse, through marks of enunciation that provoke the subject effect.

Tradução: Este artigo pretende analisar como o caráter dos magistrados, os enunciadores das sentenças judiciais, nelas se apresenta. Utilizando a antiga e as novas retóricas, bem como a semiótica greimasiana, visa a mostrar como a prudência e a virtude aristotélicas constituem o ethos dos juízes, produzindo credibilidade no discurso e efeitos de sujeito. Isso é feito por meio das projeções da enunciação no enunciado e recursos retórico-argumentativos.
