Challenges and Proposals for Inclusive Criminal Justice

Reflections from a Gender and Human Rights Perspective in Mexico

Abstract

The Mexican criminal justice system has taken significant steps towards the inclusion of the gender perspective, through laws and protocols that seek to eradicate gender violence and guarantee equality in judicial processes. However, challenges persist, such as structural discrimination and lack of training of legal operators, which prevents the effective implementation of these policies. This essay analyzes the advances and challenges of the criminal justice system in Mexico, highlighting the importance of continuous training and the effective application of the gender perspective in the interpretation of laws. In addition, it proposes that the Mexican judicial system must become a transformative agent, not only by punishing acts of violence, but also by working in a preventive manner to guarantee a life free of violence for all people, regardless of their gender.
