Abstract

This paper analyses the Brazilian’s labor law formation and the workers influence in this process. We speculate that labor law and syndical system built in Brazil by the strong State participation in its origin and the influence of the workers in this process had been important to consolidate a tradition that tends to inhibit significant changes in the collective and individual right of the work in the country. This occurs not only because of the legal aspects, but also because of the symbolic aspects that involve the relations between State and the organizational structure of the workers.
